  • To overcome this, India has published new mental health legislation called the Mental Healthcare Act (MHCA) 2017, which came into force on 7 July 2018.

  • MHCA aims to protect and promote the rights of people with mental illness during the delivery of healthcare in the community and to ensure mental healthcare treatment and rehabilitation in a good manner.

  • Another important reform brought by MHCA is the decriminalization of suicide attempts. Until recently, attempted suicide was punishable.

  • MHCA states that any person who attempts to commit suicide will be presumed to suffering from severe stress and the government will have a duty to provide care, treatment and rehabilitation for such people.

Fundamental rights

  • Fundamental rights are rights granted to each Indian citizen under part III of the Indian constitution

  • They are protected and guaranteed by the Indian constitution

  • There are 6 Fundamental Rights namely:-

    • Right to Equality

    • Right to Freedom

    • Right against Exploitation

    • Right to Freedom of Religion

    • Cultural and educational rights

    • Right to Constitutional Remedies

  • These rights are known as fundamental rights as they are enforceable by courts and an individual can approach a court of law in case of a breach
